These Patient App & Website Terms of Use ("Terms") govern your access to and use of the SnapShot Health Inc website located at https://snapshothealth.io and any patient-facing mobile or web application provided by SnapShot Health Inc (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Role of SnapShot Health

SnapShot Health Inc ("SnapShot") provides a technology platform that enables patients to view health information made available by their Healthcare Providers and to transmit patient-generated health data, including manual readings, to those Providers.

SnapShot does not provide medical advice, medical diagnosis, medical treatment, clinical decision-making, clinical monitoring, clinical oversight, or any obligation to review, interpret, escalate, respond to, or act upon patient data.

SnapShot is not a healthcare provider and does not enter into a physician–patient or other healthcare provider–patient relationship with you.

2. Healthcare Providers Are Responsible for Care

All medical care, clinical services, treatment decisions, and health-related advice are provided solely by your Healthcare Provider. Your Healthcare Provider is independent of SnapShot and is solely responsible for:

• Determining medical necessity and appropriateness of care
• Reviewing, interpreting, and responding to patient data
• Making all clinical decisions
• Establishing monitoring protocols, escalation criteria, and response timing

Any information displayed through the Service is presented as received and is not reviewed, validated, or acted upon by SnapShot.

If you submit manual readings or other information through the Service, you acknowledge and agree that:

• You are solely and exclusively responsible for the accuracy, completeness, and timeliness of all information you submit
• Manual readings may be inaccurate, incomplete, or misleading
• SnapShot does not verify, validate, correct, monitor, or review submitted data
• Your Healthcare Provider may rely on submitted data as provided

SnapShot disclaims all liability arising from inaccurate, incomplete, delayed, or erroneous patient-submitted data.

5. No Duty to Monitor or Respond

SnapShot expressly disclaims any duty to monitor, review, respond to, escalate, triage, or act upon patient data.

SnapShot does not guarantee that:

• Data will be reviewed within any specific timeframe
• Providers will be notified of submissions
• Alerts or thresholds will result in provider action

You should not rely on the Service as a substitute for direct communication with your Healthcare Provider.

6. Eligibility and Minors

The Service is not intended for use by individuals under 18 without the consent and involvement of a parent or legal guardian. If you are a minor, please do not provide us or other website visitors with any personal information.

BY USING THE SITE OR OBTAINING SERVICES FROM THE WEBSITE, YOU REPRESENT AND WARRANT THAT YOU MEET ALL OF THE ELIGIBILITY REQUIREMENTS AND YOU AFFIRM THAT YOU ACCEPT AND ARE BOUND BY THESE TERMS. IF YOU DO NOT MEET ALL OF THESE REQUIREMENTS, YOU MUST NOT ACCESS OR USE THE WEBSITE.

You are prohibited from violating or attempting to violate the security of the Site, including accessing data not intended for such user, attempting to breach security measures, introducing malicious software, or engaging in any activity that interferes with the Website.

We have the right to disable your access to the Website at any time in our sole discretion for any or no reason.

SnapShot disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement or course of performance. We do not warrant that our Service will always be available, access will be uninterrupted, be error-free, meet your requirements, or that any defects in our Service will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, SnapShot shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, under any legal theory, arising out of or in any way relating to our Service or Website.

SnapShot's total aggregate liability for any claim, whether in contract, tort, statute, or otherwise, shall not exceed $100, and this cap applies in the aggregate, not per incident, claim, or theory of liability.

SnapShot may suspend or terminate your access to the Service at any time, with or without notice, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

14. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by confidential binding arbitration under the Federal Arbitration Act and the rules of the American Arbitration Association.

Arbitration shall occur in Dallas County, Texas, on an individual basis only. You waive any right to participate in class or representative actions.

YOU AND SNAPSHOT HEALTH INC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If this Agreement to Arbitrate provision is found to be unenforceable, then exclusive jurisdiction and venue for any claims will be in state or federal courts located in and for Dallas County, Texas.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

16. Changes

SnapShot may update these Terms at any time. If such changes are made, they will be effective immediately, and we will notify you by a notice posted on our Website's home page of any material changes. Your continued use after a change to these Terms has been posted constitutes your acceptance of the Terms as modified.
